GS-2: Statutory, Regulatory and various Quasi-judicial Bodies; Issues Relating to Development and Management of Social Sector/Services relating to Health, Education, Human Resources. 

Context: The Joint Parliamentary Committee (JPC) examining the Viksit Bharat Shiksha Adhishthan (VBSA) Bill, 2025 has raised concerns that the proposed single higher education regulator could lead to excessive concentration of powers and undermine institutional autonomy.   

About the Viksit Bharat Shiksha Adhishthan (VBSA) Bill, 2025

• Objective: Seeks to implement the National Education Policy (NEP), 2020 by establishing a unified, transparent and outcome-oriented regulatory framework for higher education. 

• Apex Regulatory Body: Establishes the Viksit Bharat Shiksha Adhishthan (VBSA) as the apex regulator by replacing the University Grants Commission (UGC), All India Council for Technical Education (AICTE) and National Council for Teacher Education (NCTE). 

• The Commission will function through three specialised Councils—Regulatory, Accreditation and Standards Councils. 

• Composition: The Commission will comprise a Chairperson and up to 12 members, including the Presidents of the three Councils, the Higher Education Secretary, eminent experts and representatives from State Higher Education Institutions. 

• Functions of the Councils: The Regulatory Council will regulate Higher Education Institutions (HEIs) and facilitate institutional autonomy; the Standards Council will prescribe learning outcomes and minimum academic standards; while the Accreditation Council will develop the accreditation framework for HEIs. 

• Scope: Covers higher education, including technical, teacher-training and architecture education, while excluding medical, legal and certain other professional institutions. 

• It also applies to Institutions of National Importance (INIs), Central and State universities, and deemed universities. 

• Degree-awarding Powers: Degrees may be conferred only by universities established under law, institutions empowered by a Central Act, or other HEIs authorised by the Regulatory Council with prior approval of the Central Government.

Significance of the Bill

• Unified Regulatory Architecture: Replaces multiple regulators with a single framework, reducing regulatory overlap and improving coordination. 

• Alignment with NEP 2020: Advances the NEP's vision of simplified governance, multidisciplinary education and improved quality of higher education. 

• Functional Specialisation: Separate Regulatory, Accreditation and Standards Councils enable specialised oversight within a common institutional framework. 

• Reduced Conflict of Interest: Separating regulation from funding promotes greater transparency and objective oversight of higher education institutions.

Key Concerns Raised by the Parliamentary Panel

• Excessive Concentration of Powers: Vesting regulatory, accreditation, standards-setting and enforcement powers in a single body may weaken institutional checks and balances. 

• Need for Stronger Safeguards for INIs: While retaining IITs, IIMs and other Institutions of National Importance within the proposed framework, the Committee sought stronger statutory safeguards to protect their autonomy. 

• Centralisation of Decision-making: Greater control by the Union Government over appointments and policy decisions may weaken the federal character of higher education governance. 

• Wide Penalty Powers: Broad powers to impose penalties and take regulatory action could result in arbitrary or excessive intervention in institutional functioning. 

• Limited Independent Appellate Mechanism: Appeals against decisions of the Councils lie with the Central Government, raising concerns over the absence of an independent appellate authority.

Recommendations of the Committee

• Protect Institutional Autonomy: Incorporate stronger statutory safeguards to preserve the autonomy of Institutions of National Importance (INIs) under the VBSA framework. 

• Strengthen Federal Representation: Ensure greater representation of States and State universities in the governance structure of the Commission. 

• Prevent Arbitrary Penalties: Clearly define the scope and application of the graded penalty framework and ensure transparent procedures before imposing penalties. 

• Ensure Timely Appointments: Frame rules to initiate the process of filling predictable vacancies at least six months in advance and complete appointments within 90 days. 

• Strengthen Accountability: Introduce adequate institutional checks and oversight mechanisms to ensure that the Commission functions in a fair, transparent and consultative manner.
